Oil and Gas leasing is complicated and can affect families and their children for years. Many counties in Wyoming (Platte, Goshen, Laramie, Niobrara) and in Colorado (Weld and Larimer) have seen a recent explosion of leasing activities for horizontal wells in the Niobrara formation. Horizontal wells leases involves specialized issues which do not exit in typical vertical wells. Chief among the concerns for both the oil and gas company and the landowner are those involving lease access, surface use, use of water, protection of surface, groundwater resources, and water aquifers, and disposal of frac and drilling fluids.

Other concerns involve consideration of the size of leases, limiting the lease term, restriction of formation use, royalties and rentals, mandatory drilling committments, and protection from environental and other legal liability.

We have recently negotiated several Niobrara formation horizontal well leases and complicated Surface Use Agreements in Southeastern Wyoming, Northeastern Colorado.
